If you do not have permission, do not buy any virtual items.

Why Not Labs is not a party to and is not responsible for the payment arrangements and transactions. Why Not Labs does not control how you pay or how you get the items. Why Not Labs does not collect or store your financial information. If you face any problem during in-app purchase payments, contact Apple or for android devices directly contact to Google.

10. Prices for virtual items are shown in local currency and do not include taxes or changes that apply in the country you access the any of our games game. Prices for virtual items which might change from time to time are displayed in the app.

11. When you buy or earn Virtual Items, we give you a non-exclusive, personal, non-transferable, non-sub-licensable, and revocable license to use these virtual items to play the any of our games game, but you do not own these virtual items.

13. If you change your device and download the any of our games game to your new device, all virtual items you purchased via in-app purchases except non-consumable items will be lost.

18. You agree that we do not have to give you any refund for or any other compensation relating to virtual items, including when your account is suspended or terminated and/or if you stop using and/or delete the any of our games game.

19. Your service provider may charge you for data usage when you play any of our games on a device that is not connected to Wi-Fi. You are responsible for the payment of any other fees relating to the use of any of our games, such as internet and data costs and data roaming costs.

20. As Why Not Labs, we own the copyright and other intellectual property rights in the any of our games. You agree that you do not have and do not will to have any rights in the any of our games game except the limited license we give to you which is a non-exclusive, non-transferable, personal license for your own personal, non-commercial entertainment purposes to download, access and use the any of our games game.

21. We can terminate this license by giving you notice at any time.

· attempt to gain access to the source code, structure or algorithms of the underlying software of the app.

· use the app or any of its content in any manner to or to incite others to, attack, harass, abuse, stalk, threaten, defame or otherwise infringe or violate the rights of any other person, including based on their race, ethnicity, national origin, religious affiliation, sexual orientation, sex, gender, gender identity or disabilities.

· use the app to promote, arrange or discuss terrorism or terrorist acts or otherwise to host terrorist content.

· use the app or any of its content to create libelous, defamatory, obscene, discriminatory, indecent, suggestive, harassing, bullying, threatening, abusive, inflammatory, fraudulent, or illegal material, or any material that infringes or violates another person’s rights (including, intellectual property rights, or rights of privacy or publicity).

25. We would appreciate it if you could give us a chance to fix errors or other areas you are unhappy with before you leave any reviews about any of our games.

These third-party websites are not under our control, and we are not responsible for and do not endorse their content or their privacy policies (if any). 29. Nothing in these Terms and Conditions excludes or limit our liability for death, personal injury, or fraudulent misrepresentation caused by our negligence nor exclude or limit our liability for any other things where the law does not permit us to do so.

30. You agree to indemnify and hold the Why Not Lab Parties harmless from any claim, including legal fees, arising out of any breach or alleged breach by you of these Terms and Conditions, your use of the app, your behavior in the app and your breach of any law or the rights of a third party.

31. These terms of use and Privacy Policy are the entire agreement between you and Why Not Labs. As Why Not Labs, we can transfer our rights under this agreement to others (if we sell all or part of our business to someone else). You cannot transfer any of your rights under this agreement to any third party.

32. If any of these Terms and Conditions are not enforceable, the rest will remain in place in full force and effect. If we do not enforce any of the terms or delay in doing so, this will not constitute a waiver of our rights.

33. The Terms are concluded between Why Not Labs and you only, and not with Apple, and, as between Apple and us or with Google, and, as between Google and us, we are solely responsible for the app and the content thereof.

The license granted to you for the app under the Terms and Conditions is limited to a non-transferable license to use the App on any Apple-branded products that you own or control and as permitted by the Apple Usage Rules set out in the App Store Terms of Service, except that such app may be accessed, acquired, and used by other accounts associated with the purchaser via “Family Sharing” or volume purchasing. On any Android products that you own or control and as permitted by the Google Usage Rules set out in the Google Play Store Terms of Service, except that such app may be accessed, acquired, and used by other accounts associated with the purchaser via “Family Sharing” or volume purchasing

35. Apple , Google and its subsidiaries are third-party beneficiaries of the Terms and Conditions and will have the right (and will be deemed to have accepted the right) to enforce these Terms and Conditions against you as a third-party beneficiary thereof.

36. We take intellectual property rights very seriously. All the artworks (including images, characters, story, effects, and the music) are created by The Why Not Labs Team.
